Minutes:

The Panel considered an application for a new Premises Licence in respect of 119 Lytham Road submitted by Asam Khan. The proposed licence was for the sale of alcohol for consumption off the premises between 8am and 12Midnight daily.

 

Mr T Colebourne, Solicitor for the Applicant was in attendance.

 

Mr M Marshall  on behalf of the Licensing Authority and Public Health was also in attendance

 

PC Lisa Evans, Lancashire Constabulary, was in attendance.

 

The Panel noted that the application was situated within Bloomfield ward one of the four wards that form part of the Off-Licence Saturation Policy. The effect of this policy is to create a rebuttable presumption against the granting of additional licences.

 

They noted Mr Colebourne’s submission that the application would be subject to conditions as agreed with the responsible authorities, that the applicant currently operated the premises at 113 Lytham Road and that this application was a proposal to move from that premises to the application premises.

 

The Panel expressed concern that both licences might continue to operate thus undermining the Cumulative Impact Policy and therefore only accepted the application if this could not happen.

 

Resolved:

 

That the application for a Premises Licence for 119 Lytham Road be granted subject to the conditions agreed with the responsible authorities.

 

That the Premises Licence not take effect until the Premises Licence for Locals, 113 Lytham Road has been surrendered and 29 days has expired since that surrender without a reinstatement being received by the Licensing Service.
