The Licensing Panel considered the appointment of a Chairman for the meeting.

Resolved:

That Councillor Hunter be appointed Chairman for the meeting.

Members are asked to declare any interests in the items under consideration and in doing so state:-

(1) the type of interest concerned

(2) the nature of the interest concerned; and

(3) whether they have or have not sat on a Planning Committee which has previously considered a planning application in respect of a licensed premises which is also subject to consideration for a premises licence as part of the agenda for this meeting.

If any Member requires advice on declarations of interests, they are advised to contact the Head of Democratic Governance in advance of the meeting.

There were no declarations of interest on this occasion.

The Chairman of the Panel will summarise the procedure and announce the equal maximum amount of time for each party to speak for the hearing.

A.         Items 1 and 4 (b) will be undertaken in private session by the Panel and not in the Meeting Room.

B.         Items 2, 3 and 4(a) will be recommended to the Panel to be held in public.

C.         The Panel may decide to exclude the public from all or part of a hearing where it considers that the public interest in so doing outweighs the public interest in the hearing, or that part of the hearing, taking place in public. (This includes a party and any person assisting or representing a party)

The Chairman explained the procedure for the meeting including that an equal time limit of 20 minutes had been allocated for all parties to give representation, and 5 minutes for summing up.

To consider a new application for a Premises Licence for Ocean King, 104-106 Talbot Road, FY1 3AY.

B.      Determination of the new Premises application

The Licensing Panel will indicate how the decision is to be communicated to interested parties.

The Licensing Panel considered an application for a Premises Licence in respect of Ocean King 104-106 Talbot Road FY1 3AY, the application requested permission for Late Night Refreshment only Monday to Sunday 23:00 to 05:00, with the premises being open to the public between 13:00 and 05:00 daily.

Mr David Owen was representing the case on behalf of the applicant Mr Ibrahim Samy Aboelmaged both who were in attendance before the panel, Mr Aboelmaged was described as an experienced business owner who had operated another late night establishment serving food with having not drawn the attention of the licensing authority or brought the reputation of his business into disrepute. Mr Owen informed the panel that his client had been working with the police having put additional measures in place such as additional door staff. No objections had been received from any of the responsible authorities.

Objection had been received from members of the public, Mr Mark Marshall of M Squared on behalf of Mr Emad Ramadan Abdelmaaboud Elsawi Hammouda of King Kebab who were present before The Panel and Sady Bogdan who did not attend but whose written submission were considered in their absence.

Mr Mark Marshall of M Squared on behalf of Mr Emad Ramadan Abdelmaaboud Elsawi Hammouda wished to object to the granting of the Premises Licence, Mr Marshall made reference to Cumulative Impact Area which effected the proposed location for the premises application, Mr Marshall also made reference to recent police and crime data which demonstrated a trend of increased crime in the same area, Mr Marshall continued by stating increased trend in figures representing crime and disorder in the area and that this should be taken into consideration.

The Panel considered representations from Mr Owen and Mr Marshall, it acknowledged the objection received however the Panel had taken into account that the applicant had not applied to sell alcohol and had agreed to put extra door staff in place to help greater safeguard against crime and disorder in the area, this reflected positively with the Panel and was accepted as a condition to the Licence should it be granted.

The Panel noted that no objections had been received from responsible authorities, it also noted considered that there would not be any significant negative impact on Licensing Objectives. The Panel therefore decided on balance to depart from policy and grant the licence.

To grant the Premises Licence in relation to Ocean King.
