APPOINTMENT OF CHAIRMAN

To appoint a Chairman for the meeting.

Minutes:

The Licensing Panel considered the appointment of a Chairman for the meeting.

 

Resolved:

 

That Councillor Hutton be appointed Chairman for the meeting.

2.

DECLARATION OF INTEREST - LICENSING

Members are asked to declare any interests in the items under consideration and in doing so state:

 

(1) the type of interest concerned

 

(2) the nature of the interest concerned; and

 

(3) whether they have or have not sat on a Planning Committee which has previously considered a planning application in respect of a licensed premises which is also subject to consideration for a premises licence as part of the agenda for this meeting.

 

If any Member requires advice on declarations of interests, they are advised to contact the Head of Democratic Governance in advance of the meeting.

 

Minutes:

There were no declarations of interest on this occasion.

3.

PROCEDURE FOR THE MEETING

The Chairman of the Panel will summarise the procedure and announce the equal maximum amount of time for each party to speak for the hearing.

 

A.         Items 1 and 4 (b) will be undertaken in private session by the Panel and not in the Meeting Room.

B.         Items 2, 3 and 4(a) will be recommended to the Panel to be held in public.

C.         The Panel may decide to exclude the public from all or part of a hearing where it considers that the public interest in so doing outweighs the public interest in the hearing, or that part of the hearing, taking place in public. (This includes a party and any person assisting or representing a party)

Minutes:

The Chairman explained the procedure for the meeting including that an equal time limit had been allocated for all parties.

APPLICATION TO REVIEW A PREMISES LICENCE - KAOS BAR pdf icon PDF 507 KB

To consider an application to review the Premises Licence for Kaos Bar, 38-42 Queen Street, Blackpool, FY1 2AY.

 

A. Application and representations submitted. To consider the attached report.

B. Determination of the application to review the Premises Licence for Kaos Bar.

 

The Licensing Panel will indicate how the decision is to be communicated to interested parties.

The Licensing Panel considered an application to review the Premises Licence of Kaos Bar, 38-42 Queen Street. The Review Application had been submitted by Lancashire Constabulary  on the grounds of the Prevention of Crime and Disorder, Public Safety, the Prevention of Public Nuisance and the Protection of Children from Harm, with supporting representations having been submitted by Environmental Protection, the Licensing Authority and 3 members of the public.

 

In attendance at the hearing were PC Guy Harrison and PC Emma Pritchard from Lancashire Constabulary along with Mr Lee Petrak on behalf of the Licensing Authority. The Licence holder and Designated Premises Supervisor Mr Neil Cropper was in attendance accompanied by his agent Mr Mark Marshall.

 

Prior to the start of considering the evidence submitted by all parties, the Licensing Panel considered a request for a deferral of one month submitted by the Licence Holder and supported by the Lancashire Constabulary and the Licensing Authority.

Mr Mark Marshall, Licence Holder’s agent, explained that he had requested amore detailed information on the police crime logs which had formed part of the police evidence, so that areas of explanation, agreement and dispute could be presented.

This detailed information had been requested from the police who explained that it would take some time to collate and would not be available until the week commencing 7 November 2022.

 

In view of this information- the Licensing Panel considered that a one-month deferral would be possible to enable further in depth consideration of the issues and with the agreement of the parties to the hearing.

 

Resolved:

 

That the review of the Premises Licence in respect of Kaos Bar to deferred to the meeting of the Licensing Panel on the 5 December 2022.
