APPOINTMENT OF CHAIRMAN

To appoint a Chairman for the meeting.

Minutes:

The Committee considered the appointment of a Chairman for the meeting.

 

Resolved:  That Councillor Humphreys be appointed Chairman for the meeting.

2.

DECLARATION OF INTEREST - LICENSING

Members are asked to declare any interests in the items under consideration and in doing so state:-

 

(1) the type of interest concerned

 

(2) the nature of the interest concerned; and

 

(3) whether they have or have not sat on a Planning Committee which has previously considered a planning application in respect of a licensed premises which is also subject to consideration for a premises licence as part of the agenda for this meeting.

 

If any Member requires advice on declarations of interests, they are advised to contact the Head Democratic Governance in advance of the meeting.

 

(Members are asked to also pay particular attention to the guidance sheet on interests supplied with the agenda).

3.

PROCEDURE FOR THE MEETING

The Chairman of the Panel will summarise the procedure and announce the equal maximum amount of time for each party to speak for the hearing.

 

A.         Items 1 and 4 (b) will be undertaken in private session by the Panel and not in the Meeting Room.

B.         Items 2, 3, 4(a) and 4(c) will be recommended to the Panel to be held in public.

C.         The Panel may decide to exclude the public from all or part of a hearing where it considers that the public interest in so doing outweighs the public interest in the hearing, or that part of the hearing, taking place in public. (This includes a party and any person assisting or representing a party)

The Chairman explained the procedure for the meeting including that an equal time of fifteen minutes had been allocated for all parties.

The Licensing Panel noted that Environmental Protection had recently withdrawn their representation objecting to the application to vary a Premises Licence in respect of Ma Kelly’s, Foxhall Road and as such the hearing in respect of this application was cancelled.

The Licensing Panel considered an application to vary a Premises Licence in respect of Ma Kelly’s, Talbot Road requesting an extension of the hours for the sale of alcohol and provision of regulated entertainment until 4am on Friday and Saturday with the premises closing to the public at 4.30am. 

 

Mr Woosnam, solicitor representing the applicant, was in attendance at the meeting, accompanied by Mr Sugden, Manager of the Premises.  Mr Woosnam presented the application and accepted that the premises was within the Council’s designated Town Centre Saturation Area but due to the demographic of the clientele and the effective management of the Premises, he did not consider that the extension of hours as requested would impact further on the cumulative impact already experienced in the area.  He requested that the Panel, if it was not minded to grant the application, to consider allowing a short extension to the current hours for licensable activities with the closing time remaining at 4am.

 

Sergeant Parkinson, Lancashire Constabulary, was in attendance at the meeting and made representations to the Panel.  She reported that Lancashire Constabulary’s main concern was the location of the Premises which was within the Council’s Town Centre Saturation Area and as such considered that an extension to the sale of alcohol and opening hours would negatively impact on the cumulative impact already experienced in the area.  She presented statistical information on the incidents of crime and disorder already experienced which she attributed to the number of licensed premises and takeaway establishments operating in the area. 

 

Sergeant Parkinson concluded by stating that, although extending the hours for the sale of alcohol remained a concern, Lancashire Constabulary’s principal objection was the potential impact on the licensing objective of crime and disorder should an extension to the opening hours beyond 4am be granted. 

 

In response to concerns raised by the Panel, Mr Woosnam and Mr Sugden reported on the security measures undertaken at the Premises which included CCTV and security personnel.

 

The Panel considered the application and noted that it was located within the designated Town Centre Saturation Area.  The Panel was satisfied that a short extension to the hours for the sale of alcohol and provision of regulated entertainment would not impact on the licensing objective of crime and disorder.  However, Members were not persuaded that an extension of the opening hours beyond 4am would not impact on the licensing objective of crime and disorder. The Panel therefore agreed to grant the application for the extension of the sale of alcohol and provision of regulated entertainment until 3.30am but to restrict the opening hours to 4am rather than the requested time of 4.30am.

 

Resolved:  To agree a variation in the Premises Licence in respect of Ma Kelly’s, Talbot Road to permit the sale of alcohol and regulated entertainment until 3.30am on Friday and Saturday with the Premises closing to the Public at 4am.
