APPOINTMENT OF CHAIRMAN

To appoint a Chairman for the meeting.

Minutes:

The Licensing Panel considered the appointment of a Chairman for the meeting.

 

Resolved:

 

That Councillor Hunter be appointed Chairman for the meeting.

2.

DECLARATION OF INTEREST - LICENSING

Members are asked to declare any interests in the items under consideration and in doing so state:-

 

(1) the type of interest concerned

 

(2) the nature of the interest concerned; and

 

(3) whether they have or have not sat on a Planning Committee which has previously considered a planning application in respect of a licensed premises which is also subject to consideration for a premises licence as part of the agenda for this meeting.

 

If any Member requires advice on declarations of interests, they are advised to contact the Head Democratic Governance in advance of the meeting.

 

(Members are asked to also pay particular attention to the guidance sheet on interests supplied with the agenda).

3.

PROCEDURE FOR THE MEETING

The Chairman of the Panel will summarise the procedure and announce the equal maximum amount of time for each party to speak for the hearing.

 

A.         Items 1 and 4 (b) will be undertaken in private session by the Panel and not in the Meeting Room.

B.         Items 2, 3, 4(a) and 4(c) will be recommended to the Panel to be held in public.

C.         The Panel may decide to exclude the public from all or part of a hearing where it considers that the public interest in so doing outweighs the public interest in the hearing, or that part of the hearing, taking place in public. (This includes a party and any person assisting or representing a party)

Minutes:

The Chairman explained the procedure for the meeting including that an equal time of twenty minutes had been allocated for all parties.

The Licensing Panel considered an application to vary the Premises Licence in respect of the Bull Hotel, 17 Waterloo Road to request an extension of the hours for the sale of alcohol and provision of regulated entertainment  09.00 – 02.00 hours daily, to permit late night refreshment 23.00 – 02.00 hours daily, to amend the opening hours of the premises to 09.00 – 02.30 hours daily and to amend the wording of condition 1 in Annexe 2.

 

Mr John McKenzie, the manager and Designated Premises Supervisor, was in attendance accompanied by Mr Richard Taylor, the applicant’s solicitor and both outlined the application. Mr Taylor highlighted that the premises was well-run and was seeking the extension to the opening hours to enable further flexibility in the operation of the premises and it was not intended that the premises would operate until 2am all the time. Mr Taylor emphasised that the premises already operated until 2am on bank holidays and other special occasions and that there had been no complaints received on those occasions. Mr McKenzie in response to questions explained that he was keen to work with local residents and volunteered to close the beer garden at 11.30pm

 

The public objector was not in attendance but the Panel considered their representations as included on the agenda.

 

The Panel expressed concern at the late opening and the potential for the licensing objective of public nuisance to be undermined however they sought to balance this with the premises good operation and relatively few issues. The Panel agreed therefore to grant the licence variation only on Fridays, Saturdays, Sundays and Mondays.

 

Resolved:

 

1.      That the application for a variation of the Premises Licence in respect of the Bull Hotel be granted until 2am on Friday, Saturday, Sunday and Mondays only.

 

2.      That the hours of operation  remain until 2am on Maundy Thursday, Christmas Eve, Boxing Day and New Year’s Eve.

 

3.      That an additional condition be added to the licence that the beer garden must close at 11.30pm.
