Appointment of Chairman

To appoint a Chairman for the meeting.

Minutes:

The Licensing Panel considered the appointment of a Chairman for the meeting.

 

Resolved:

 

That Councillor Hutton be appointed Chairman for the meeting.

2.

Declaration of Interest - Licensing

Members are asked to declare any interests in the items under consideration and in doing so state:-

 

(1) the type of interest concerned

 

(2) the nature of the interest concerned; and

 

(3) whether they have or have not sat on a Planning Committee which has previously considered a planning application in respect of a licensed premises which is also subject to consideration for a premises licence as part of the agenda for this meeting.

 

If any Member requires advice on declarations of interests, they are advised to contact the Head Democratic Governance in advance of the meeting.

 

(Members are asked to also pay particular attention to the guidance sheet on interests supplied with the agenda).

Procedure for the Meeting

The Chairman of the Panel will summarise the procedure and announce the equal maximum amount of time for each party to speak for the hearing.

 

A.         Items 1 and 4 (b) will be undertaken in private session by the Panel and not in the Meeting Room.

B.         Items 2, 3, 4(a) and 4(c) will be recommended to the Panel to be held in public.

C.         The Panel may decide to exclude the public from all or part of a hearing where it considers that the public interest in so doing outweighs the public interest in the hearing, or that part of the hearing, taking place in public. (This includes a party and any person assisting or representing a party)

Minutes:

The Chairman outlined the procedure for the meeting including that an equal time limit of twenty minutes had been allocated to all parties.

The Licensing Panel considered an application for the review of the Premises Licence in respect of North Parade Guest House, 68-70 Dickson Road. The review had been submitted by the Licensing Authority and supported by representations from Lancashire Constabulary and the Child Protection Licensing Officer.

 

Mr Mark Marshall from the Licensing Authority was in attendance and made representations to the Panel. He outlined the reasons behind the submission of the review but highlighted the cooperative attitude of the licence holder and suggested that the review could be dealt with by the Panel agreeing to add a number of proposed conditions onto the licence. Mr Marshall also sought an undertaking from the licence holder to attend the next training course organised by the Licensing Authority to improve his knowledge of the risks of Child Sexual Exploitation.

 

PC Ben Reynolds was in attendance on behalf of Lancashire Constabulary and outlined his support for the additional conditions.

 

Mr Patrick Buckley, Designated Premises Supervisor, was in attendance on behalf of the Licence Holder accompanied by his solicitor Ms Samantha Faud. Mr Buckley expressed regret as to the incidents that had led to the submission of the review and expressed a keenness to work with the responsible authorities. His agreement to the proposed conditions as a way forward.

 

The Licensing Panel endorsed the proposed conditions and noted Mr Buckley’s undertaking to attend the Child Sexual Exploitation Awareness training.

 

It warned Mr Buckley that if issues returned and a further review submitted it would consider stronger action in the future.

 

Resolved:

 

1.      That the review of the Premises Licence in respect of North Parade Guest House be dealt with by the imposition of the following conditions:

 

i)                    Any person under the age of 18 must be accompanied by a responsible adult and remains the responsibility of the accompanying adult at all times when using the premises. Members of staff are not allowed to be in sole supervision of children.

ii)                  There shall be no persons under 18 on the premises from 21.30 other than residents. Residents who are under 18 are not permitted in the licensed area or in the beer garden after 21.30 unless in the case of emergency or for access reasons only.

iii)                All members of staff shall receive suitable training with regard to serving drunks and are to receive regular refresher training at intervals of a maximum of six months. Records to evidence this shall be made available to an authorised officer upon request.

iv)                Any person who appears to be intoxicated or who is behaving in a disorderly manner shall not be allowed entry to the venue. Any person who appears to be intoxicated or who is behaving in a disorderly manner shall be given care and consideration in leaving the venue.

v)                  From 20.00 hours on Friday and Saturday evenings there will be one SIA registered door supervisor employed until all non-residential customers have left the premises.
