Appointment of Chairman

To appoint a Chairman for the meeting.

Minutes:

The Licensing Panel considered the appointment of a Chairman for the meeting.

 

Resolved:

 

That Councillor Maycock be appointed Chairman for the meeting.

2.

Declaration of Interest - Licensing

Members are asked to declare any interests in the items under consideration and in doing so state:-

 

(1) the type of interest concerned

 

(2) the nature of the interest concerned; and

 

(3) whether they have or have not sat on a Planning Committee which has previously considered a planning application in respect of a licensed premises which is also subject to consideration for a premises licence as part of the agenda for this meeting.

 

If any Member requires advice on declarations of interests, they are advised to contact the Head Democratic Governance in advance of the meeting.

 

(Members are asked to also pay particular attention to the guidance sheet on interests supplied with the agenda).

Procedure for the Meeting

The Chairman of the Panel will summarise the procedure and announce the equal maximum amount of time for each party to speak for the hearing.

 

A.         Items 1 and 4 (b) will be undertaken in private session by the Panel and not in the Meeting Room.

B.         Items 2, 3, 4(a) and 4(c) will be recommended to the Panel to be held in public.

C.         The Panel may decide to exclude the public from all or part of a hearing where it considers that the public interest in so doing outweighs the public interest in the hearing, or that part of the hearing, taking place in public. (This includes a party and any person assisting or representing a party)

Minutes:

The Chairman explained the procedure for the meeting including that an equal amount of time had been allocated to all parties.

The Licensing Panel considered an application to review the Premises Licence in respect of Ned Kelly’s, 19-23 Clifton Street, the application had been submitted by Lancashire Constabulary. The review was a summary review based on a serious incident at the premises under section 53A Licensing Act 2003. The Licensing Panel had met on the 4 August 2016 and agreed as an interim step the suspension of the licence.

 

PC Emma Pritchard was in attendance and presented the evidence on behalf of Lancashire Constabulary. She highlighted the Police’s concerns regarding the premises as the Licence Holder at the time of submission of the review remained in custody on charges of a very serious nature alleged to have taken place on the premises. Subsequent to this event the Designated Premises Supervisor had not been contactable.  An application had been submitted to transfer the licence however the Police had concerns given the applicant was related to  the previous Licence Holder. The Police expressed concern given the lack of contact with the proposed new operator of the premises and considered that they would not be able to uphold the Licensing Objectives.

 

The Panel noted that the Licence Holder had been informed of the hearing and agreed to consider the application for a review in their absence given the statutory deadlines and that they had been informed of the hearing.

 

The Panel also noted that representations had been made in support of the review application by Social Services

 

The Licensing Panel considered carefully the evidence submitted by all parties. It expressed serious concerns regarding the undermining of the Licensing Objectives. This was further evidenced by the lack of contact between the proposed new Premises Licence Holder and the responsible authorities since the Licence Holder entered custody.

 

Resolved:

 

That the Premises Licence in respect of Ned Kelly’s, 19-23 Clifton Street be revoked.
