Appointment of Chairman

To appoint a Chairman for the meeting.

Minutes:

The Licensing Panel considered the appointment of Chairman for the meeting.

 

Resolved:  That Councillor Hutton be appointed Chairman for the meeting.

2.

Declaration of Interest - Licensing

Members are asked to declare any interests in the items under consideration and in doing so state:-

 

(1) the type of interest concerned

 

(2) the nature of the interest concerned; and

 

(3) whether they have or have not sat on a Planning Committee which has previously considered a planning application in respect of a licensed premises which is also subject to consideration for a premises licence as part of the agenda for this meeting.

 

If any Member requires advice on declarations of interests, they are advised to contact the Head Democratic Governance in advance of the meeting.

 

(Members are asked to also pay particular attention to the guidance sheet on interests supplied with the agenda).

Procedure for the Meeting

The Chairman of the Panel will summarise the procedure and announce the equal maximum amount of time for each party to speak for the hearing.

 

A.         Items 1 and 4 (b) will be undertaken in private session by the Panel and not in the Meeting Room.

B.         Items 2, 3, 4(a) and 4(c) will be recommended to the Panel to be held in public.

C.         The Panel may decide to exclude the public from all or part of a hearing where it considers that the public interest in so doing outweighs the public interest in the hearing, or that part of the hearing, taking place in public. (This includes a party and any person assisting or representing a party)

The Chairman explained the procedure for the meeting and advised that both parties would be allowed a maximum of 15 minutes to speak.

The Panel considered an application for a Temporary Event Notice (TEN) in respect of an event taking place at Moo Bistro, 31-33 Queen Street, Blackpool between 26th and 28th March 2016.

 

The applicant, Ms Whiteside, accompanied by the premises’ owner, Mr Roche, was in attendance at the meeting.  Also in attendance was Ms Pritchard, representing Lancashire Constabulary.

 

Mr Roche addressed the Panel on behalf of the applicant, explaining that he had acquired the premises several months ago and at that time had been unaware of the conditions attached to the licence.  He reported on his ownership of a number of licensed premises within Blackpool and his lack of any problems in relation to the operation of the premises.  He advised the Panel of the reasons for the request for the extended hours over the Easter weekend which included the opportunity to recoup some of the significant expenditure he had incurred following his acquisition of the premises and in view of the fact that the majority of the bars in the immediate vicinity were open until 5am. 

 

The Panel noted that the terms of the existing Premises Licence permitted the sale of alcohol on Bank Holidays to be extended until 03.00 hours on the following morning.  It also noted that the existing licence conditions would not normally apply to a TEN.

 

Responding to questions from the Panel, Mr Roche, on behalf of the applicant, confirmed the intention to operate the premises under the existing licensing conditions throughout the extended hours applied for, should the application be approved. 

 

Ms Pritchard, on behalf of Lancashire Constabulary, confirmed that it did not have any objection to the extension of the extended hours provided that the normal licensing conditions applied during that time.

 

Resolved:  That the application be approved, subject to the premises operating under the relevant conditions of its existing Premises Licence throughout the extended hours.
