Appointment of Chairman

To appoint a Chairman for the meeting.

Resolved:

 

That Councillor Evans be appointed Chairman of the Panel for this meeting.

2.

Declaration of Interest - Licensing

Members are asked to declare any interests in the items under consideration and in doing so state:-

 

(1) the type of interest concerned

 

(2) the nature of the interest concerned; and

 

(3) whether they have or have not sat on a Planning Committee which has previously considered a planning application in respect of a licensed premises which is also subject to consideration for a premises licence as part of the agenda for this meeting.

 

If any Member requires advice on declarations of interests, they are advised to contact the Head Democratic Governance in advance of the meeting.

 

(Members are asked to also pay particular attention to the guidance sheet on interests supplied with the agenda).

Councillor Evans declared that he knew Mr Bullock, who was representing the public objectors, in a personal capacity.

Procedure for the Meeting

The Chairman of the Panel will summarise the procedure and announce the equal maximum amount of time for each party to speak for the hearing.

 

A.         Items 1 and 4 (b) will be undertaken in private session by the Panel and not in the Meeting Room.

B.         Items 2, 3, 4(a) and 4(c) will be recommended to the Panel to be held in public.

C.         The Panel may decide to exclude the public from all or part of a hearing where it considers that the public interest in so doing outweighs the public interest in the hearing, or that part of the hearing, taking place in public. (This includes a party and any person assisting or representing a party)

The Chairman explained the procedure for the meeting including a guideline time limit of thirty minutes for all parties.

The Licensing Panel considered an application for a new Premises Licence in respect of Loasu Food and Wine, 168-170 Ashfield Road. The application being for the sale of alcohol for consumption off the premises between the hours of 8am and 11pm.

 

The applicant, Mr Vipudhsan, accompanied by his agent, Mr Jordan, was in attendance and outlined his application. Mr Jordan highlighted the nature of the application as a convenience store selling a range of goods including alcohol and that a number of proposed conditions had been agreed with Lancashire Constabulary to ensure that the application did not impact on the Licensing Objective of Prevention of Crime and Disorder. The Panel expressed concern about Mr Vipudhsan lack of experience running licensed premises.

 

The Panel heard from a number of public objectors including Mr Bullock on behalf of Mrs Mullineaux, Mr Sprigg, Mrs Dyson and Mrs Evans. The objectors highlighted their areas for concern including anti-social behaviour within the area. While acknowledging that the Police had not objected, they highlighted their view that they were problems existing in the area and these were only limited by the good management of the existing off licence in the area.

 

In response to issues raised by the objectors, the Panel was reminded by Mrs Davies, Head of Licensing Service, that covenants on the use of premises were not a relevant consideration for the Licensing Panel.

 

The Panel considered carefully the application, the representations, the Council’s Statement of Licensing Policy and the Secretary of State’s guidance.

 

The Panel concluded that there were serious problems in the area and that the granting of an additional licence particularly to a relatively inexperienced operator would undermine the licensing objectives. The Panel did not consider that its concerns

 

Resolved:

That the application for a Premises Licence in respect of Loasu Food and Wine be refused.
