The Application
On 5th August 2013, the licensing service received an application to licence the New Ryton Hotel, 14-16 Woodfield Road Blackpool
The following activities were sought:
1. Live music 11.00 - 00.00 (01.00 Christmas Eve and New Years Eve)
2. Recorded music 07.00 - 02.00
3. Performance of dance 11.00 - 02.00
4. Entertainment of a similar description 12.00 - 00.00
5. Late night refreshment 23.00 - 00.00 New Years Eve
6. Sale of alcohol for consumption on the premises 11.00 - 02.00
The regulated entertainment is to take place in the cabaret lounge, although recorded music is also to be played in the dining room.

The premises was previously licensed for live and recorded music 20.00 - 00.00 and for the sale of alcohol for consumption on the premises 24 hours a day to residents and bona fide guests only. This licence was surrendered in August 2012 as the premises had then ceased trading.
The applicant has agreed the following additional conditions with the Police. These conditions will be added to the licence if granted:
The following conditions to be added to the operating schedule:
1. An incident book will be maintained, in which shall be recorded (i) All incidents of crime and disorder (ii) Refused sales to suspected under age / drunken persons (iii) A record of any person refused admission or asked to leave the premises (iv) Details of occasions upon which the Police are called to the premises (v) The use or discovery of drugs That book shall be available for inspection by a Police Officer or authorised person.
2. The Licence Holder and the Designated Premises Supervisor are to support and rigorously enforce a Challenge 25 Proof of Age policy. Any person who looks or appears to be under the age of 25 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable: (a) UK photo driving licence (b) passport (c) Proof of Age Standards Scheme Card OR (d) any other nationally or locally approved form of identification which may be introduced in the future. If no suitable identification is provided, sale of alcohol to them will be refused.
3. All staff to have received suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this will be made available to an authorised officer upon request.
4. Signs promoting the Challenge 25 policy shall be prominently displayed at public entrances and alcohol sales areas.
5. An authorisation, signed and dated by the Designated Premises Supervisor, shall be kept at the premises showing all persons authorised by them to make sales of alcohol at the premises. All staff involved in sales will be at least 18 years of age and will receive training to promote the licensing objectives. All training to be documented and records made available on request to a Police Officer or any authorised officer.
6. No person in possession of an alcoholic drink in an unsealed container shall be allowed to enter or leave the premises. Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
7. The outside area of the premises will not be used for the consumption of alcohol after midnight on any day.
8. Functions which specifically target young people (for example 18th birthday parties) will not be allowed to take place on the premises.
9. Children will be accompanied by adults at all times in all licensable areas of the premises, however are not permitted in the cabaret lounge after 21.00 hours.
10. The premises will operate as a hotel, with additional use for pre-booked musical performances, and pre-booked private functions. The sale of alcohol will be ancillary to these uses. No person will be permitted to enter and consume alcohol inside the premises if they are not attending the premises for the above reasons.
The following conditions to be removed from the operating schedule:
11. Children are not permitted in the cabaret lounge after 21.00 hours.
12. A Challenge 25 scheme will be in operation at the premises. Any person who appears to be under the age of 25 shall be asked to provide identification that they are over the age of 18.

PANEL'S REASONS FOR REACHING ITS DECISION
The Panel considered the evidence submitted by the applicant and the objectors.
It noted the conditions agreed with the applicant and both Lancashire Constabulary and Environmental Protection.
The Panel agreed that it was necessary and proportionate to impose the following conditions
1. That the sale of alcohol be limited to residents and their bona-fide guests and to the bona fide guests of performing aristes.
2. That the maximum capacity of the licensable area be limited to 60.
That the hours and activites will limited as follows
Live Music 11.00 to 23.00 (01.00 on Christmas Eve and New Year's Eve)
Recorded Music 07.00 to 00.00 (01.00 on Christmas Eve and New Year's Eve)
Performance of Dance 11.00 to 00.00 (01.00 on Christmas Eve and New Year's Eve)

PANEL DECISION
That the application for a premises licence for the New Ryton Hotel, 14-16 Woodfield Road be granted subject to the conditions agreed already with Lancashire Constabulary, Environmental Protection and the additional conditions outlined above.
