Scoffs Diner

The Application

This application is for a new premises licence for Scoffs Diner, 8-10 Back Church Street, Blackpool and if granted would permit late night refreshment between the hours of 23:00 and 04:00 and the supply of alcohol by retail for consumption on the premises only between the hours of 11:00 and 03:00. It is proposed that the premises close to the public at 04:00. These times are for all days of the week.

The licensing service received a valid objection from a member of the public, namely Margaret Carson the proprietor of Scruffy Murphy, Corporartion Street, Blackpool.

This premises is located within the Cumulative Impact area identified in the Council's licensing policy.

During the consulation period the applicant agreed a number of additions to the operating plan which would be included as conditions were a licence to be granted.

PANEL'S REASONS FOR REACHING ITS DECISION

The Panel carefully considered the application, the representations and the licensing objectives.

The Panel agreed that it would not be reasonable to refuse the application but that the application should be granted subject to the following conditions.

1. That Late Night Refreshment take place between 11.00pm and 3.30am Monday to Sunday.

2. That the sale of alcohol take place between 11am and 2.30am Monday to Sunday.

3. That the premises be open to the public 8.30am to 3.30am

4. That last admission take place at 2.30am on any day.

5. That no children shall be allwed in the premises after 11.00pm.

6. No entertainment of any adult nature will take place on the premises.

7. Meals and substantial refreshment will be available at all times.

8. Only toughened glasses or polycarbonate vessels will be used at the premises.

9. Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.

10. The supply of intoxicating liquor for consumption on the premises shall be by waiter /waitress service only and only to persons seated at tables or seated at the bar.

11. Suitable beverages other than intoxicating liquor (including drinking water) shall be equally available for consumption, with or otherwise as an ancillary to, food served in the licensed premises.

12. At least one personal licenced holder will be available (i.e contactable by telephone at all times the premises are open and able to attend within 30 minutes of the call) while the supply or sale of alcohol is being undertaken (whose identity will be known to all other staff engaged in the supply of alcohol) except in the case of emergency.

13. Another member of staff shall be nominated to act for the Designated Premises Supervisor, in their absence, whose identity is known by all other staff when such absence occurs.

14. CCTV will be installed internally and externally at the premises and will comply with the following:

- The CCTV system shall be installed, maintained and operated to the reasonable satisfaction of Lancashire Constabulary. All public areas of the premises are to be covered by the system. The system will incorporate a camera covering each of the entrance doors and will be capable of providing an image which is regarded as identification standard.

- The system will display on any recording the correct time and date of the recording.

- The system will make recordings during all hours the premises are open to the public.

- VCR tapes or digital recordings shall be held for a minimum of 31 days and 28 days respectively, after the recording is made and will be made available to the Police or any authorised person acting for a Responsible Authority for inspection on request.

- The system will, as a minimum record images of the head and shoulders of all persons entering the premises.

15. Any person under the age of 18 admitted to the premises will be accompanied by an adult at all times.

16. Children will not be allowed in the bar serving area

17. A Challenge 25 proof of age policy shall be implemented and adhered to. All staff to have received suitable training in relation to the Challenge 25 proof of age scheme. Records to evidene this will be made available to an authorised officer upon request.

18. An adequate number of licensed door supervisors will be on duty as appropriate to any risk assessment and in accordance with the guidance under the Nightsafe scheme, with a ratio of doorstaff to customers of 1:100.

19 Risk asssessments carried out by or on behalf of the Licence holder which relate to a licensing objective will be available for inspection by an officer or a Responsible Authority.

20. Security/ staff arrangements are sufficient to discourage the sale and consumption of drugs and shall ensure such arrangements include regular checks of toilet areas.

21. A zero tolerance drugs policy will be adopted at the premises.

22. Recoprds of incidents involving the use and/or detection of drugs shall be maintained and those records shall be available for inspection.

23. Confiscated/found drugs shall be stored in a safe and recorded in an incident book. The police shall be informed and collection arranged.

24. There shall be placed at all exit points from the premised in a place where they can be seen and easily read by the public, clear and legible notices requiring customers to leave the premises and the area quietly so as to minimise disturbance to nearby residents.

25. The collection and disposal of bottles and refuse should not take place externally between the hours of 2200 and 0530 so as to minimise disturbance to nearby residents.

26. No playing of recorded music shall take place outside at any time including incidental music.
