Viva

The Application

The application for consideration is for a new premises licence relating to a premises to be called 'Viva', 3 Church Street, Blackpool, FY1 1HH.

Permission is sought to provide regulated entertainment, late night refreshment and the sale of alcohol for consumption on the premises from 11:00 every day of the week until 01:00 the following morning. The applicant proposed that the premises is open to the public from 8:00 until 02:00.

Local Policy Considerations

The premises is situated in the Town Centre Saturation area. There is a rebutable presumption in the Council's Licensing Policy that the application will be refused. Onus is on the applicant to demonstrate that the premises licence, if granted, would not impact adversely on the licensing objectives.

PANEL'S REASONS FOR REACHING ITS DECISION

The Panel considered the licensing objectives, the application form, supplementary evidence from the applicants and the objections.

The Panel considered that the licence should be granted but it was necessary and proportionate to reduce the hours of operation to uphold the licensing objective of prevention of crime and disorder.

The Panel noted the conditions submitted in the original application and the additional conditions offered by the applicant . It was also agreed to clarify that there would be no adult entertainment of a sexual nature.
PANEL DECISION

That the premises licence be granted subject to the hours of licensable activity being restricted to between 11am and 0030am and the conditions submitted by the applicant.
