APPLICATION FOR A PREMISES LICENCE - AB Pizza, 149 Layton Road, Blackpool, FY3 8HH

Minutes:

The Licensing Panel considered an application for a new Premises Licence in respect of AB Pizza, 149 Layton Road. The application sought permission to offer late night refreshment between the hours of 2300 and 0100 7 days a week. The premises would open between 1300 and 0100 daily.

 

The applicant Mr Omer Altinok was in attendance along with his representative Mr Mark Marshall and made representations to the Licensing Panel. Mr Marshall explained that Mr Altinok had run the premises for a number of years without issue or any concern being raised by the responsible authorities. In view of that he should be considered an experienced operator and the proposal represented in reality a relatively modest increase in opening hours. Mr Marshall further outlined that Mr Altinok was keen to be a good neighbour and would implement a code of conduct for delivery drivers to avoid causing issues.

 

The public objector Ms Suzanne Rowney was in attendance and made representations to the Licensing Panel. Ms Rowney highlighted her concerns about the premises’ operation and particularly the extension of hours. Ms Rowney emphasised that the premises was located in a prominently residential area and that it had previously been the subject of noise complaints. The Licensing Panel noted that enforcement action had not been taken and the responsible authorities had not raised any objection.

 

The Licensing Panel considered the evidence submitted by both parties. It concluded that given the residential nature of the area and previous issues with the premises that the new Premises Licence would significantly undermine the Licensing Objectives and particularly the objective Prevention of Public Nuisance. It did not consider that there were conditions or amendments that would overcome the issues.  

 

Resolved:

 

That the application for a Premises Licence in respect of AB Pizza, 149 Layton Road, be refused.
