APPOINTMENT OF CHAIRMAN

To appoint a Chairman for the meeting.

Minutes:

The Licensing Panel considered the appointment of a Chairman for the meeting.

 

Resolved:

 

That Councillor Hutton be appointed Chairman for the meeting.

2.

DECLARATION OF INTEREST - LICENSING

Members are asked to declare any interests in the items under consideration and in doing so state:-

 

(1) the type of interest concerned

 

(2) the nature of the interest concerned; and

 

(3) whether they have or have not sat on a Planning Committee which has previously considered a planning application in respect of a licensed premises which is also subject to consideration for a premises licence as part of the agenda for this meeting.

 

If any Member requires advice on declarations of interests, they are advised to contact the Head Democratic Governance in advance of the meeting.

 

(Members are asked to also pay particular attention to the guidance sheet on interests supplied with the agenda).

PROCEDURE FOR THE MEETING

The Chairman of the Panel will summarise the procedure and announce the equal maximum amount of time for each party to speak for the hearing.

 

A.         Items 1 and 4 (b) will be undertaken in private session by the Panel and not in the Meeting Room.

B.         Items 2, 3, 4(a) and 4(c) will be recommended to the Panel to be held in public.

C.         The Panel may decide to exclude the public from all or part of a hearing where it considers that the public interest in so doing outweighs the public interest in the hearing, or that part of the hearing, taking place in public. (This includes a party and any person assisting or representing a party)

The Chairman explained the procedure for the meeting including that an equal time of twenty minutes had been allocated for both parties.

The Licensing Panel considered an application for a Premises Licence in respect of 136-140 Promenade. The application requested permission for the sale of alcohol for consumption on and off the premises, live music and recorded music 11.00 – 02.00 hours daily.

 

The Panel noted the agreement between the applicant and the objector regarding the addition of a number of conditions to the licence and outlined at Appendix 4b to the agenda.

 

Mr T Colebourne, solicitor, outlined the application on behalf of Mr S Oyston, the applicant, who was also in attendance. Mr Colebourne highlighted that the application was for a high quality premises which would be food led and appeal to a different demographic that were currently catered for in Blackpool and that the premises would be well run by experienced operators.  Mr Colebourne explained that by negotiation the applicant and police had been able to agree a substantial number of conditions to address the police’s concerns with the only area of disagreement being the hour between 1 and 2am. Mr Colebourne outlined his view that the premises would due to its clientele not impact on the crime and disorder occurring in the area. Mr Colebourne emphasised that in his view that the hours applied for were essential for the proposed operation of the premises.

 

In response to concerns raised  from the Panel, Mr Oyston explained that the sales for consumption off the premises applied only to alcohol sold for consumption in the outside area and as applicant he was prepared to accept a condition to that effect.

 

Sgt Parkinson and PC Pritchard both outlined the objection on behalf of Lancashire Constabulary. She highlighted that in broad terms the police were satisfied that the application would not significantly impact on the cumulative impact in the area apart from at the period post 2am when there already were significant challenges in the area. Sgt Parkinson gave a number of examples and evidence on the ongoing problems in the area around 2am.

 

The Licensing Panel considered carefully the evidence submitted and concluded that the application should be granted but to avoid impacting on the crime and disorder already being experienced in the areas to restrict the terminal hour for the sale of alcohol to 1am.

 

 

Resolved:

 

1.      That the application for 136-140 Promenade be granted with the terminal hour for the sale of alcohol to be 1am with the premises to close one hour later.

 

2.      That the conditions as agreed between the applicant and the Police and outlined at Appendix 4b be added to the licence.

 

3.      That an additional condition be added to the licence “No person may remove alcohol from the grounds or curtilage of the licensed premises, unless it is to be consumed in the external drinking area on the Promenade/ Queen Street Blackpool “
