Appointment of Chairman

To appoint a Chairman for the meeting.

Resolved:

 

That Councillor Hutton be appointed Chairman for the meeting.

2.

Declaration of Interest - Licensing

Members are asked to declare any interests in the items under consideration and in doing so state:-

 

(1) the type of interest concerned

 

(2) the nature of the interest concerned; and

 

(3) whether they have or have not sat on a Planning Committee which has previously considered a planning application in respect of a licensed premises which is also subject to consideration for a premises licence as part of the agenda for this meeting.

 

If any Member requires advice on declarations of interests, they are advised to contact the Head Democratic Governance in advance of the meeting.

 

(Members are asked to also pay particular attention to the guidance sheet on interests supplied with the agenda).

3.

Procedure for the Meeting

The Chairman of the Panel will summarise the procedure and announce the equal maximum amount of time for each party to speak for the hearing.

 

A.         Items 1 and 4 (b) will be undertaken in private session by the Panel and not in the Meeting Room.

B.         Items 2, 3, 4(a) and 4(c) will be recommended to the Panel to be held in public.

C.         The Panel may decide to exclude the public from all or part of a hearing where it considers that the public interest in so doing outweighs the public interest in the hearing, or that part of the hearing, taking place in public. (This includes a party and any person assisting or representing a party)

The Chairman explained the procedure for the hearing but noted that it was clear that an agreement could be reached between all parties.

The Panel considered an application for the review of the Premises Licence in respect of the Coliseum Off Licence,.

 

Mr M Marshall was in attendance on behalf of the applicant for the review, Weights and Measures, additionally Mr Marshall also presented the representations on behalf of the Licensing Authority and Health and Safety. He explained that since the review had been submitted that there had been good progress in improving the operation of the premises and he proposed dealing with the review by the imposition of conditions and a reduction in the hours of operation.

 

PC Evans on behalf of Lancashire Constabulary was also in attendance and confirmed that the Police had agreed this course of action.

 

Mr S Alosh, the Licence Holder, was in attendance and explained the circumstances of the premises. He explained that he has seeking to sell the premises soon, his focus had been away from the running of the business and regretted that standards had fallen at the premises. He confirmed his agreement to the changes to the operating schedule.

 

The Panel therefore concluded that it would best ensure that the Licensing Objectives if the Licence was amended in line with the agreement of all parties.

 

Resolved:

 

1.      That the terminal hour for the sale of alcohol be amended to 2300 hours Monday to Satruday.

 

2.      That the following additional conditions be added to the licence:

 

i)                    The Licence Holder is to support and rigorously enforce Challenge 25 proof of age policy.

Any person who looks or appears to be under the age of 25 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable:-

UK Photo driving licence

Passport

Proof of age Standards Scheme card

ii)                  A refusals book will be used to record all occasions on which a sale of alcohol has been refused

iii)                Staff will received refresher training in respect of the proof of age policy at least every 4 months. The Licence Holder will keep documentary records of such training.

iv)                That all members of staff attend the training organised by the Licensing Authority by the 30th November 2015.
