To agree the minutes of the last meeting held on 24 May 2017 as a true and correct record.

The Committee considered the minutes of the last meeting hel d on 24 May 2017.

 

Resolved:

 

That the minutes of the meeting held on 24 May 2017 be approved and signed by the Chairman as a correct record.

FORMATION OF A PUBLIC PROTECTION SUB-COMMITTEE pdf icon PDF 48 KB

To consider the formation of a Public Protection Sub- Committee for the forthcoming Municipal Year.

Minutes:

The Committee considered the formation of a Public Protection Sub-Committee for the forthcoming Municipal Year 2018/2019. Members also considered whether to appoint the Chairman and Vice-Chairman of the Public Protection Sub-Committee at this meeting.

 

Resolved:

 

1.      To agree to the constitution of a politically balanced Public Protection Sub-Committee with a membership of 7 (5 Labour and 2 Conservative).

 

2.      To note the membership of the Public Protection Sub-Committee as Councillors Collett, Hobson, Humphreys, Hutton, Singleton, Robertson BEM and Mrs Scott.

 

3.      That the functions assigned to the Public Protection Sub-Committee continue to be those as set out in Part 3 of the Council’s Constitution.

 

4.      To agree to appoint the Chairman and Vice-Chairman of the Public Protection Sub-Committee at this meeting.

 

5.      To appoint Councillor Hutton as Chairman of the Public Protection Sub-Committee for Municipal Year 2018/2019.

 

6.      To appoint Councillor Collett as Vice-Chairman of the Public Protection Sub-Committee for Municipal Year 2018/2019.

 

4.

CHANGES TO THE LICENSING ACT pdf icon PDF 48 KB

To update the Committee on changes to the Licensing Act 2003 brought about by the Policing and Crime Act 2017.

 

Minutes:

The Committee received an update from Mrs Sharon Davies, Senior Solicitor, on recent and anticipated changes to the Licensing Act 2003 brought about by the Policing and Crime Act 2017.

 

Mrs Sharon Davies, Senior Solicitor, explained that the creation of the new Section 5A which replaced Cumulative Impact Policies such as the Council had in place in the town centre for on sales and in the central wards for off sales with Cumulative Impact Assessments. The new guidance required Cumulative Impact Assessment to be published and reviewed at least every three years where a Council considered that there was a significant impact on the licensing objectives were more licensed to be granted. Mrs Davies recommended that officers be tasked with preparing draft versions of such assessments and reporting back to a future meeting.

 

Mrs Davies further explained that the proposed amendments to the Late Night Levy had still not been brought in force and that further consultation had now been proposed between the Government and Late Night Refreshment Operators therefore it would not now be implemented until after that had taken place.

 

Resolved:

 

1.      To note the update.

 

2.      To instruct officers to review the areas covered by existing Cumulative Impact Policies with a view to publishing  Cumulative Impact Assessment.

To update the Committee on the details of licences applied for, dealt with and appealed in the period 1 May 2017 to 10 May 2018.

Minutes:

The Licensing Committee received an update on the details of licences applied for, dealt with and appealed in the period 1 May 2017 to 10 May 2018.

 

Mrs Sharon Davies, Senior Solicitor, highlighted to the Committee details of the 39 licences granted administratively as no objections had been received, the one application for a Premises Licence refused by the Licensing Panel, the six reviews of Premises Licences considered by the Licensing Panel and the decisions and information on pending applications. Mrs Davies further highlighted that it the past year there had been two appeals submitted but that both had been withdrawn prior to the court hearing.
