To agree the minutes of the last meeting held on 8 November 2016 as a true and correct record.

The Licensing Committee considered the minutes of the last meeting held on 8 November 2016.

 

Resolved:

 

That the minutes of the last meeting held on 8 November 2016 be approved and signed by the Chairman as a correct record.

3.

CREATION OF A PUBLIC PROTECTION SUB-COMMITTEE pdf icon PDF 207 KB

To consider the constitution of a Public Protection Sub- Committee for the forthcoming Municipal Year.

 

Minutes:

 

The Committee considered the constitution of a Public Protection Sub-Committee for the forthcoming Municipal Year 2017/2018.  Members also considered whether to appoint the Chairman and Vice-Chairman of the Public Protection Sub-Committee at this meeting.

 

Resolved:

 

1.      To agree to the constitution of a politically balanced Public Protection Sub-Committee with a membership of 7 (5 Labour and 2 Conservative).

 

2.      To note the membership of the Public Protection Sub-Committee as Councillors Collett, Hobson, Humphreys, Hutton, Singleton (replaced by Councillor O’Hara for the meeting on 24 May 2017), Robertson BEM and M Scott.

 

3.      That the functions assigned to the Public Protection Sub-Committee continue to be those as set out in Part 3 of the Council’s Constitution.

 

4.      To agree to appoint the Chairman and Vice-Chairman of the Public Protection Sub-Committee at this meeting.

 

5.      To appoint Councillor Hutton as Chairman of the Public Protection Sub-Committee for Municipal Year 2017/2018.

 

6.      To appoint Councillor Collett as Vice-Chairman of the Public Protection Sub-Committee for Municipal Year 2017/2018

 

 

4.

CHANGES TO THE LICENSING ACT pdf icon PDF 215 KB

To update the Committee on changes to the Licensing Act 2003 brought about by the Immigration Act 2016 and the Policing and Crime Act 2017.

 

Minutes:

The Committee received an update from Mrs Sharon Davies, Head of Licensing Service on recent changes to the Licensing Act 2003 caused by the Immigration Act 2016 and the Policing and Crime Act 2017.

 

Mrs Davies highlighted the new requirements under the Immigration Act 2016 for Taxi Drivers and Operators to prove their right to work in the UK and for Licensing Authorities to issue time-limited licences to mirror the period that licensees were permitted to work in the UK. The Committee also noted the addition of Home Office Immigration Enforcement as a responsible authority under the Licensing Act 2003 able to object to the granting or transfer of licences.

 

Mrs Davies then highlighted the minor legislative changes under the Police and Crime Act 2017 and that new Section 182 guidance would be issued by the Secretary of State to reflect the changes and forwarded to members of the Committee.

To update the Committee on the details of licences applied for, dealt with and appealed in the period 22 October 2016 to 30 April 2017.

 

Minutes:

The Licensing Committee received an update on the details of licences applied for, dealt with and appealed during the period 22 October 2016 to 30 April 2017.

 

Mrs Sharon Davies, Head of Licensing Services, highlighted the twenty-eight new Premises Licence applications granted as no representations had been received, the two licences refused and one licences granted by the Licensing Panel, the actions of the Licensing Panel regarding the twenty-three licence reviews and the details of the one appeal pending.
