HOUSEHOLDER DUTY OF CARE : ENVIRONMENTAL PROTECTION ACT 1990

Purpose:

To inform Blackpool Council of changes to the Environmental Protection Act 1990 (sections 34 and 34(2A)) in relation to updated guidance on waste (known as ‘householder duty of care’) and new guidance for local authorities on issuing proposed Fixed Penalty Notices.

 

The new provisions provide for a fine of not less than £150 and not more than £400 as specified by the waste collection authority and £200 if no amount is specified by the authority.

 

Decision:

1.      To approve the proposals set out within the report to enable enforcement of the provisions of sections 34 and 34(2A) of the Environmental Protection Act 1990.

 

2.      To agree the penalty charge for the offence of ‘Householders Duty of Care’ now be set at £400 reduced to £120 if paid within 10 days.

 

3.      That delegated authority be granted to the Director of Community and Environmental Services under the Environmental Protection Act 1990 Section 34 (as amended) to make appropriate arrangements for issuing fixed penalty notices for the failure to demonstrate householder duty of care requirements.
