1. DECLARATIONS OF INTEREST

There were no declarations of interest made.

2. MINUTES, 10th June 2005

Resolved:
That the minutes of the meeting of the Licensing Committee held on the 10th June be approved and signed by the Chairman as a correct record.

3. LICENSING QUARTERLY UPDATE1- PERIOD FROM SECOND APPOINTED DAY

The Committee received a Quarterly update on Licensing during the period up to the Second Appointed Day. It was noted that since the Authority had become responsible for Licensing, it had dealt with a total of 172 Premises Licences and 1768 Personal Licences. This had resulted in a total of 197 Licensing Panel hearings being scheduled.

Resolved:
That the Licensing Quarterly updated be noted.

4. TEMPORARY EVENT NOTICES

Mrs Davies provided the Committee with an update on the legislation and regulations surrounding Temporary Event Notices. Mrs Davies explained that where a premise to be used for licensable activities during a period not to exceed 96 hours or where the maximum number of persons to be adopted did not exceed 500- a Temporary Event Notice could be served. The Police would be the only body that could object and if that was the case- a meeting of the Licensing Panel would be held to determine the application

Resolved:
That the update be noted.

5. LICENSING PANEL PROCEDURE- PERIODIC REVIEW

The Committee considered the procedure for Licensing Panel meetings, which had previously been adopted by the Licensing Committee at its meeting on the 31st January 2005. The procedure was reviewed by the Committee in light of members' experience of Licensing Panel meeting. The Committee agreed that in light of these meetings, the procedure should be amended to include an opportunity for both sides to sum up.

Resolved:
That the Head of Legal and Democratic Services be requested to bring a report to the next meeting of the Committee outlining the amended Licensing Procedure.

6. LICENSING PANEL HEARING ARRANGEMENTS- POST SECOND APPOINTED DAY

The Committee considered how best to arrange Licensing Panels in the period after the Second Appointed Day. It was proposed that Panel meetings would be arranged weekly, alternately on Tuesdays and Thursdays on a rota basis.

Resolved:
That the Head of Legal and Democratic Services continue to appoint Panels as proposed, to consieder Licensing applications.

7. FORMATION OF A PUBLIC PROTECTION SUB-COMMITTEE

In light of the recent amendments to the Council's Committee, the Committee considered re-appointing a Public Protection Sub-Committee. The Sub-Committee would be politically-balanced and deal with the functions of the previous Public Protection Committee. It was proposed that the Public Protection Sub-Committee be reconvened with 7 members in the proportion 4, 3, 1.

Resolved:
That the Public Protection Sub-Committee be re-appointed with seven members.
